Terrible, The fact that I am a non-custodial parent to two children have caused me to be behind bars 34 days at one time at Cook County Jail, because of my unemployment status. I am also a full time college student, so I missed over a month of class while in jail. Im also a custodial parent to one of my sons, so while I was in jail my mom babysat for me. The laws should be changed to prevent non-custodial parents from being locked up, simply because thay cannot aford to pay child support. Even though the judge knew that I was a single dad to one son and a full time student, he still placed me in jail for over a month for failure to pay $300 a month in child support. When coming up with the child support payment order, the judge said that this was the minimum order he would set for anyone having a child, regardless of the fact an individual is unemployed. |

| I am a full time college student and single Dad trying to make it in this world we live in. I am a custodial parent to one son and non- custodial parent to two other children. I have been locked up more times than a few for failure to pay child support. This is because. at the time I was ordered to pay child support, I was unemployed but told by the judge that I would still be ordered to pay a default amount ($300 a month) in child support. So whenever I try to see any of the other kids with the visitation order I was granted, there mom calls the police to arrest me. So every weekend I have a choice, try to see my other two kids and risk arrest or stay home with the one I haver custody of. Its a shame that this is the situation. I now owe over $15,000.00 in back child support because I was unemployed and unable to pay $300 a month and still cannot afford to pay $300.00 a month in child support. Im all for supporting kids, if your not employed, you should find some sort of hustle to bring home some cash for the kids, however, to set an amount that you cant pay is not the right way to handle the problem. I hustle every week on some dough for my kids if I can find some money somewhere, I give it to the kids mom. Every time I go before a judge in court, he tells me to pay $300 a month plus arearage which I cannot afford, so he tells me to come back and if you dont have the money, he says he will put me in jail until I do. The last time, I was locked up, it was for 34 days. I believe the judge thought I had some money somewhere that I wasnt telling him about, in the time of being behind bars, I gather he figured otherwise and released me. I survive and take care of the son I have, with the help of college financial aid and Illinois Link card for groceries. So to all the dads that really want to see your child but cant, I understand, neither can I. |
